ETJ
Resolution Passed -- Sent to Commissioners
On Tuesday, Sept. 26, the Village Council passed the ETJ
Resolution and has sent it on to the Union County
Commissioners for review. After months of discussion, the
Council selectively chose those un-incorporated county parcels
the were surrounded on all sides by Wesley Chapel, adjoined
Wesley Chapel on at least 2 sides. The County Commissioners
will likely hold a public hearing on October 16 and make a
decision on the issue November 7th.

Public Hearing draws 150+ to air concerns
The Village Council held a Public Hearing on
it's plan for requesting ETJ (Extra Territorial Jurisdiction),
last Thursday, Sept. 7th. For more than 3 hours, council
members heard citizen comments that both condemned and
supported the ETJ resolution. The council will vote on the
scope of the parcels included in the ETJ resolution in an upcoming
meeting, that will be presented to the County Commissioners.

SCHOOL
BOARD VOTES TO CAP WESLEY CHAPEL ELEMENTARY
At last night's monthly meeting, the
School Board voted to give Dr. Davis the authority to cap the
student enrollment of Wesley Chapel Elementary. Currently,
1118 children attend school, the majority in 30 mobile
classrooms. While no magic number was specified, approximately
20 to 30 more students will be allowed to attend, after which
all new students will be diverted to next closest
elementary. |

Wesley
Chapel Volunteer Fire Department to hold Public Hearing
The WCVFD have or is in the process of purchasing lot #5 of
the recently sub-developed land now called Plyler Ridge. The subdivision
is adjacent to the current Fire Department. The public hearing
(August 22nd @7:00pm) will concern the financing of a loan on
the purchase. Wesley Chapel Volunteer Fire Department is
funded directly by property tax on landowners in the fire
district, |

Union
Power Substation permit - upheld!
The Union County Board of Adjustment voted 6-1 to uphold the
zoning permit granted Union Power to build a substation on the
property at the corner of Will Plyler and New Town Road. The
hearing consisted of 45 minutes of testimony by both sides,
followed by a cross examination of 10 minutes. BOA Board
members then asked a number of questions which was followed by
a vote. Unlike the Wesley Chapel Village hearings on the
'Conditional Use Permit' for the original property, the
Stonegate HOA appeal was on county zoned land where residential
property used for a substation is a 'Use by Right' and only
required a zoning permit before building. The breath of
testimony was much less, and unlike the Wesley Chapel
proceedings, the burden of proof was on the Homeowners to
prove that Union Power did not meet the requirements laid out
County zoning -- namely the screening. |

Union
Power Sub Station Appeal Hearing Scheduled for August 7
The "Appeal" of the zoning permit issued to Union
Power to build a power substation at the corner of Will Plyler
and New Town Road will be heard by the Union County Board of
Adjustment on August 7, 2006 at 7:00pm at the
Union County Public Works Building, Jefferson
Room, 400 N. Church Street. The appeal was filed by Dan Healy
(a local builder and property owner) and the Stonegate
Homeowners Association.

Council Approves Condition Use Permits for School sites and
trailers
The Village Council approved with some conditions
the 8 new trailers for Wesley Chapel Elementary and the site
plan for the new elementary school at the intersection
of New Town Road and Waxhaw Indian Trail Road.
Construction will begin shortly and the school is expected to
open in August 2007. |

FIRE TAX approved for Mineral Springs VFD
Wesley Chapel residents with homes in the
Mineral Springs Fire District will now be paying a 'Fire Tax'
based on the value of their homes, rather than a flat annual
fee. to fund department operations. Mineral Springs VFD joins
the Wesley Chapel VFD and the Waxhaw VFD whose
operations have greatly expanded due to the influx of new sub developments
and businesses and are now funded via a 'Fire Tax'. Mineral
Springs has requested a 3¢ per $100 tax or $30 per $100,000
home value. In 2005, Mineral Springs collected a $33 dollar
fee per household, a 3¢ tax will generate a comparative
windfall. Citizens should note the Fire Tax District was
approved by a unanimous vote of the Union County Board of
Commissioners.

Waxhaw
Fire Chief Asks for $10,500 from town
At Monday's (June 12th) Village Council Meeting, Glyn Hasty,
the Waxhaw Fire Chief asked for an annual donation of $10,500
to help defray the costs of providing fire protection to
Village of Wesley Chapel. The council took no action on the
request. The Waxhaw VFD as well as the Mineral Springs VFD are
petitioning the county for taxing power, like that granted to
the Wesley Chapel VFD a few years ago. If granted, each fire
district will be taxing personal property at a rate per $100
of valuation, set by the Union County Commissioners. The
Mineral Springs VFD as asked for a 3¢ per $100 tax rate,
while Waxhaw has not publicly released a rate level.

rate. |

STONEGATE
SUBSTATION ROUND 2 - UNION POWER GOES ACROSS THE STREET
Taking advantage of donut holes of unincorporated Union County
land inside Wesley Chapel, Union Power plans to place a
substation across the street from the property where it's
recent application for the same use was turned down by the
Village Council. The property is 3.8 acres, formerly owned by
Joseph Mucci and sits at the NE corner of Will Plyler and
Newtown Road.

Thumbs
Down to the EJ's Thumbs Down over Library Donation
The editors of the Enquirer Journal jumped the gun by
announcing that Wesley Chapel' Village Council voted
against pledging $333,000 dollars to the construction of the
proposed Southwest Regional Library to be located in
Weddington. A presentation was made by Mayor Pro tem Rick
Croffut and discussion of the issue followed, but NO
vote was taken. The Village Council is approaching the issue
carefully and will continue the discussion at a council work session.
In fact, committing Village taxpayers should have a public
hearing and weighed heavily by what taxpayers wish. The
Enquirer Journal should also note that the Village's annual
budget is $389.000. It seems at little lopsided to expect a
small town to shoulder the same amount as the bigger towns of
Weddington and Marvin. |

Elementary
School 'H' site approved -- Relief for Wesley Chapel in 2007
Union County Commissioners approved the purchase of the 'H'
school site and the 'I' elementary school sites. Each of these
schools, will relieve the crushing over-crowding at Wesley
Chapel Elementary. The 33 acre 'H' school is to be located
just down and the right-hand side from the corner of
Waxhaw-Indian Trail Road and New Town Road, heading towards
Waxhaw. The redistricting hearing for 'H' is May 18th. It is
expected that all subdivisions along New Town Road from
Stonegate east to Potter Road will be assigned to 'H' as well
as Lindenwood to Wesley Oaks along Waxhaw Indian Trail Rd. Two
large subdivisions under construction on Billy Howie Road, may
also be earmarked for 'H'. |

25 Trailers Installed at Wesley Chapel Elementary School.
Exceeding the WC Village Council's authorized number of
mobile units, the Union County School system is installing nine
new classrooms, taking up a majority of the recreational area as
the photograph depicts. By the fall of 2006, WCES is expected to
home for more than 1250 students, more than doubling the core
capacity of the school. Total Mobil Units in place: 28

Village
selects new Village Attorney
By unanimous vote, the Village Council chose
George Sistrunk to be the new attorney,
replacing Bobby Griffin who resigned Dec, 12th. Mr. Sistrunk
law firm is located in Charlotte.

With a vote of 3-1 the Village Council found
the Union Power Substation plan was not in harmony with the
Land Use Plan nor did it fully comply with the Village zoning
ordinances. After almost 30 hours of seemingly endless
testimony, the council sifted though evidence and rendered the
best decision.

FORMER
COUNCIL LEGACY COMES HOME TO ROOST
Interestingly enough the Village Land Use Plan, designed by
the former council to cadre only to the commercial property
interests of couple large landowners was one of the major
reasons the substation was rejected. The vagueness of the Land
Use Plan regarding utilities and other uses in residential
property, left the Council with little direction. With the
substation issue behind them, the council members can
concentrate on revamping the Land Use Plan and Village's
Zoning ordinances, so they serve the whole community and the
future needs of Wesley Chapel.

Results returned this week to Union County Public Schools give the
elementary school an acceptable bill of health.

Board
Facilities Committee designates new school locations
At the committee meeting last night, Dr. Ed
Davis outlined the administration plans to build 6 new
elementary schools as well as another middle/high school cluster
by the fall of 2009. Two of the elementary schools are to be
built in the Wesley Chapel sphere by fall of 2007. The
Facilities Committee's recommendation is to locate the -H-
school in the Waxhaw-Indian Trail and New Town Road area and the
-I- school on land banked property the county owns near Airport
Road. Under Dr. Davis' schedule, the property for the -H- school
must be purchased by mid-summer 2006. Also discussed was drawing
the district lines for -H- so as to reduce the Wesley Chapel
student enrollment by at least 500 children, as was the
possibility of moving the Stonegate and Champion Forest children
to -H- as well. Note that elementary -H- is of the new larger
school design. The School Board is expected to vote on the plan
on March 7th. |

Hearing Continues Thursday Mar 2 at 6:30PM
Saturday's 7 hours of hearings completed the presentation of
both Union Power and the Stonegate homeowners testimony. The council members
move into the determination of fact segment as they assess all
the testimony offered during the Substation hearings.
Proceedings will reconvene Thursday, March 2nd, at 6:30

BOARD MAY MOVE ELEMENTARY SCHOOL 'H' TO MARVIN
Elementary school 'H, the long promised relief
for the Wesley Chapel Elementary appears to becoming a new relief school
for Marvin instead. The actual location is being shielded by
closed meetings, but as its be reported, the scheme has the
appearance of another developer boondoggle. Sandy Ridge and
Kensington being the previous two examples. If this is the
case, Sweet Union taxpayers are once again underwriting
the sewer needs for a developer who has offered 'free' land as
bait.

HERE] Those who have been told that G H and I will
be built at the same time -- will get a different impression
from the schools report.
Meanwhile, our children in Wesley Chapel might as well be
sardines. A school designed for 580 students will be home to

Stonegate
& Champion Forest to stay at WMS and WHS
At today's (Jan 17) School Board workshop on
redistricting for the new high school cluster, Board of
Education members, led by Sharon Gallagher, Kim
Rogers, John Collins and Dean Arp voted 7 to
3 to keep the Wesley Chapel subdivisions of Stonegate and
Champion Forest in the Weddington cluster rather than be moved
to the Parkwood cluster as advocated in Dr. Davis' plan. This
was a close call folks! |

The revelation that Village Council member Jim Mullis' family owns the property that Union Power wishes to place the substation comes as a surprise, but what is no surprise is that this fact was keep hidden since the process started more than 5 months ago. Compounding this deception, is the unmitigated gall of Mullis' vote to forcibly recuse Councilman Rick Croffut for a
letter to the
editor (view) he wrote before the election criticizing the previous Village Council for ostracizing Stonegate residents.

subdivision
Many newcomers to Wesley Oaks are still upset
about the failure to disclose at purchase the immensity of the 44 acre
Village Commons II shopping
center adjoining their development. Add the planned shopping center access
road into their development and one can understand the
apprehension of crime and traffic coursing by their homes. But
nothing compares to devastating impact of the news
report of a registered "Sex Offender" living in their development.

Board Representative meets with Council
Board of Education member Sharon Gallagher who
was appointed as the liaison to Wesley Chapel, made a
presentation to council last night, outlining the current status
of school construction and present WCES overcrowding.. During
the a lengthy Q&A session, Mrs. Gallagher announced the
elementary school 'H' construction which is to relieve
overcrowding at WCES is on schedule for a fall 2007 opening. She
also discussed the new ORAD report. Many of WCES parents recall
how flawed this report was in previous years forecasting growth.
Many parents voiced concerns over 'cluster' changes as to where their
children will go to middle and high schools. |

THE
Sour grapes on display by outgoing Councilman
At Monday's (Dec. 12) council meeting, just
prior to the newly elected council was administered
the oath of office, the audience of Wesley Chapel citizens as
well as invited dignitaries like County Commissioner Chairman
Roger Lane and Clerk of the Court Tripp Helms were witness to
what is best described as a tantrum by outgoing
councilman whose chose to use the invocation to demonstrate
the how contemptuous he is the community. He rambled on with phony piety until he
finished his tirade with the following biblical passage:
Isaiah 50:11
But if all you're after is making
trouble,
playing with fire,
Go ahead and see where it gets you.
Set your fires, stir people up, blow on the flames,
But don't expect me to just stand there and watch.
I'll hold your feet to those flames.
Fortunately for the future of Wesley Chapel the newly elected Village
Council are the kind of people more apt to follow Matthew 5:39
and turn the other cheek.

Committee
to study the structure and processes of all aspects of the
village government
At the first council meeting of new mayor
and council, one of the first orders of business is to create
a committee to study and make recommendations to improve the
structure and communication of the Village government and it's
various boards. Yaffa Dratman made the proposal and will
likely named as the chair of the committee.

out of 5 Village EMPLOYEES resign
As noted in today's Union Observer, 3 long
serving Village employees have tendered their resignation.
Village attorney Bobby Griffin, Tax Collector Joan Beaulieu
(announced earlier) and Clerk
Shirley Hafey (wife of Mayor Hafey) have notified Mayor Elect
Tracey Clinton of their intent to resign. It is likely the new
council will review the job descriptions, salary requirements
and actual needs prior to conducting interviews to fill the
posts. Ligon Bundy, the attorney representing the Village for
the Union Power Sub-station Conditional Use Permit will likely
fill the Village attorney post in the interim. |

| No folks this is not a new
Hardy Boys book, but a curiosity. Perhaps its just a
coincidence, but shortly after unauthorized work crews
razed the 6 acre Village Government property of all its trees, dozens
of dump
trucks loads of mulch began to show up elsewhere in Wesley
Chapel.
Just for your information: A quick check at the local
materials company, shows they sell their cheapest shredded pine bark
mulch for $19.50 per cubic yard and a dump truck holds 15
cubic yards or about $300 worth.

After hearing legal arguments both for and
against, the Village Council voted 3-0 on Council Member
Barbara Moore's motion to postpone the Public Hearing until
next month to allow the newly elected Council hear the
testimony. As scheduled, the hearing will be held Dec. 12th.

Stonegate Power Sub-Station and Town Land Re-zoning
Lead Agenda
The last regularly scheduled Council meeting of the
current term is stacked with controversial issues like
the power substation and town hall property re-zoning
as well as a new item, allowing Aston Properties to
grade the town hall property.
It should be noted that
prior to tomorrows meeting, the issue of the Town
Hall, its design or whether to build it or not has
never been on the council agenda nor presented to
Wesley Chapel citizens for public comment. The
clear cutting of the "Town Hall" land without
a vote by council on any site plan is very troublesome.
In effect, this action destroys the land for use as a
wooded park -- perhaps the intent.

calls Special Meeting for 8AM Thursday Nov. 3rd
A special Village Council meeting just 4 days before
the Village election has been called by Mayor Hafey.
Two Board of Adjustment terms which expired in August
are to be filled. Board members John Troxell and Mike
DeDora seats had expired and will likely be
re-appointed. John Troxell is also a member of the
Village Planning Board. No other issues are listed on
the agenda. |

Chapel's Candidate Forum draws a crowd of 100+
Seven of the eight candidates
running for office on the Village Council showed poise
and purpose as they answered audience submitted
questions for more than 90 minutes in WCES gym, last
night(Oct.18). It was
a milestone event. Candidates were seated in
alphabetical order, left to right; Tracey Clinton,
Rick Croffut, Bill Fairman, Brad Horvath, Barbara
Moore, Sonya Pierce and Butch Plyler. Taking turns,
each candidate offered their own prospective on a
range of questions dealing with police and safety
concerns, the meaning of "finding of facts",
future plans with managed growth, surveying of
citizens opinions and improving communications
with Village residents.

Council calls for Public Hearing on Sub-Station
With the motion made by Butch
Plyler, seconded by Jim Mullis and then approved by
all three council members, the date was set for the
public hearing on Nov. 14th to hear testimony on the
Union Power Conditional Use Permit. Again, a number of
Stonegate residents spoke in opposition to the Public
hearing. The council had the choice of tabling the
issue until after the Nov. 8th election or referring
it back to the Planning Board for further study. The
Village council hired a Monroe attorney H. Ligon
Bundy of the law firm; Perry, Bundy,
Plyler & Long, LLP to represent the Council in the
CUP issue. |

Village
Council REFUSES 800 letters from Stonegate citizens
200 Stonegate subdivision residents
each wrote letters to all four members of Village
Council; Mayor Mike Hafey, Council Members Butch
Plyler, Barbara Moore and Jim Mullis, with their
concerns about the Union Power Substation Permit
application. The 800 letters, when presented at the
Village Town Hall, were refused by the Village Clerk Shirley
Hafey, who sited a quasi-judicial nature of the issue
as a reason for refusal. Angry citizens noted that
once again this council ignores the residents, but
hear the developers loud and clear. |

Weddington
Ridge Subdivision annexation hoax
Someone for reasons unknown, placed
a flyer in the mailboxes of homeowners warning them
that Monroe would annex their sub-division and force
their children into Monroe Schools. This is completely
false for the following reasons. 1) School districting
lines are independent of municipality boarders, 2)
Wesley Chapel and Monroe have an annexation agreement,
Weddington Ridge is in the Wesley Chapel sphere, 3)
Weddington Ridge is not contiguous to either jurisdiction,
satellite annexations not withstanding. The moral of
the story is don't panic, but pay attention to what
the county and local towns are planning. Visit the

Power Neighborhood meeting about Sub-Station
The Union Power Company has invited Stonegate
residents and other sub developments as far away as
Berkshire to a presentation and discussion about Union
Power's plans to build a 7 acre power substation
across from the Stonegate sub-division. The meeting

Council
approves 5 year vested rights for JDH Capital Shopping
Center. Citing Hurricane Katrina and
its possible long-term economic ramifications, Council
member Barbara Moore chose to ignore known facts, testimony,
public comment and precedent to justify her vote to
grant JDH 5 years vested rights. In essence this gives
JDH Capital immunity from any changes in village zoning
for 5 years. State statue allows for a typical 2 year
vesting, but under extraordinary circumstances provides
a 5 year period. Council member Jim Mullis voted to
approve the vesting after agreeing with Ms. Moore's factitious
reasoning.

Member Barbara Moore moves to squelch Public Comments on
Stonegate Power Sub-station.
Just after the first
speaker in 'Public Comments' section addressed the question
of the Stonegate sub-station, Council member Barbara Moore
attempted to squelch any further comments before a standing
room only crowd of village residents. Fortunately, Mayor
Hafey saw the wisdom of allowing citizens to speak.

village council voted to table the until least October, the
question of allowing the Union Power Sub-Station CUP
(Conditional Use Permit). The Village attorney Bobby Griffin
represents both Union Power and the Village, thus causing a
conflict necessitating the Village to seek temporary legal
representation for the CUP hearing. |

Board moves to rezone Town Hall land under the yet to be
approved Office-Institutional zoning district.
Under the "Other Business" item of the
their agenda, the Planning Board moved to begin the
rezoning of the Town Hall property to the
Office-Institutional district. The Village Council has
not approved this zoning district nor has the village
citizens had the opportunity to address the council via

FORMER
COUNCIL MEMBER APPLIES FOR OPEN SEAT
Had Todd Bennington not resigned his seat in January 2004,
he would be up for re-election this November. Instead he
was the only person to apply for the seat vacated by
Camille Marshall and you may also recall that Butch Plyler
was named to fill Todd's seat. In hindsight, one could

days away, the council decided rather than select someone

rezoning and Conditional Use Permit for the Plyler
Shopping Center. More than 40 members of the public were in
attendance. Construction could begin within 15 months. |

Sign the Online Petition opposing the Shopping
Center
As of Tuesday June 24th, 225 voters
(193 at meeting time) have signed the petition urging the Village
Council to deny the Plyler Shopping Center
re-zoning. The petition was presented at
Monday's (6/13) Council Meeting. |

People attend Shopping Center Public Hearing
In spite of an ill-timed rainstorm, 158 slightly
soggy people attended last nights Village Council
Meeting. Of the 29 people who signed up to speak
only 4 people spoke in favor of the shopping center,
the owner of the old BP gas station and a lawyer for
BP as well as Becky Plyler who read a letter from
the other landowner Nancy Earnhardt. The remaining
speakers gave testimony opposing the shopping center
plans. |

being approved they have begun advertising of the
site. And why shouldn't they? Mr. Plyler has all the
votes locked up! . Lets remember how Mayor Hafey assembled
this group of like-minded people. Mr. Plyler is
appointed - he received 2 votes (Mike Hafey, Jim
Mullis), Barbara Moore is appointed - she received 2
votes (Jim Mullis and Butch Plyler) When
the actual vote takes place next month there will be
ONLY BE 1 elected person on the Village
Council. |
